1. The agreement
These terms are an agreement between you and L&M Technologies Inc., operating as Rangetel ("Rangetel", "we", "us"). They apply to our website, the Rangetel tracking platform, the phone apps, our trackers and accessories, and related services (together, the "service"). If you accept them on behalf of a company, you confirm you have authority to bind it, and "you" means that company.
If you have signed a separate agreement, quote or order form with us, its terms apply where they differ from these. Our Privacy Policy explains how we handle personal information.
2. Accounts and users
- Your account can have one or more managers, who add users and decide which units each person can see. You are responsible for everything done through your account and for your users following these terms.
- Keep sign-in details private and tell us promptly at support@rangetel.com if you suspect someone has used them without permission.
- Give us accurate contact and billing information and keep it up to date.
- You must be an adult, and you may not use the service if the law prohibits you from doing so.
3. The service
The service lets you see where your units are, review history, set alerts, run reports and manage your fleet. Features vary by plan and by tracker. We improve the service continually and may add, change or retire features; if we remove something material to a plan you have paid for, we will tell you and, where reasonable, offer an alternative or a pro-rated credit.
4. Hardware
- Ownership. Trackers and accessories you buy become yours once paid for. Trackers that are rented or included in a contract remain ours and must be returned in working order when the rental or contract ends.
- Delivery. We ship to the address you give us. Delivery times are estimates. Risk of loss passes to you on delivery.
- Installation. Install trackers as we instruct and in a way that does not interfere with the safe operation of the vehicle or equipment. Wired installations should be done by a competent installer. We are not responsible for damage caused by an installation we did not perform.
- Warranty. Hardware is covered by the warranty stated at the time of purchase. If a tracker fails under warranty, contact us and we will repair or replace it. The warranty does not cover damage from accidents, misuse, unauthorised modification, water or impact beyond the device's rating, or normal wear such as batteries.
- Returns. Contact us before returning anything. Consumers also have the return rights described in section 17.
5. Plans and billing
- Per unit. Each active tracker needs a plan. Plans are month to month, yearly, or for the term in your contract.
- Renewal. Month-to-month and yearly plans renew automatically for the same period until cancelled, and are charged in advance to your payment method on file.
- Prices. Prices are in Canadian dollars unless we state otherwise, plus applicable taxes. We may change plan prices with at least 30 days' notice; the new price applies from your next renewal after the notice period. Prices fixed in a contract do not change during its term.
- Late payment. If a payment fails, we will let you know and try again. Units on unpaid plans may be suspended (section 7) until the balance is paid.
6. Cancellation
You can cancel a plan at any time by telling us in writing, for example at support@rangetel.com. Cancellation takes effect at the end of the period you have already paid for; the unit keeps working until then. We do not refund partial periods, except where the law requires it or a contract says otherwise. Plans under a contract with a fixed term follow that contract's cancellation terms.
7. Suspension
A suspended unit stops reporting and its data is not available until it is reactivated. We may suspend units, or an account, if payment is overdue, if we reasonably believe the service is being used unlawfully or in breach of section 8, or if it is needed to protect the service or other customers. Where we can, we will warn you first. You can also ask us to suspend units, for example seasonal equipment. A reactivation fee may apply, as quoted at the time. Data from before a suspension is kept according to our retention periods.
8. Lawful and acceptable use
Tracking can affect people's privacy, so this section matters. You agree to:
- Track only what you are entitled to: vehicles, equipment and assets you own or lawfully control, and people only with their knowledge and consent or other lawful authority.
- Tell the people concerned. If employees, contractors or others drive tracked vehicles or carry trackers, you are responsible for informing them, and obtaining their consent where the law requires it, under the employment and privacy laws that apply to you.
- Never use the service to stalk, harass, threaten or covertly monitor anyone.
- Comply with all laws that apply to you, including privacy, employment, telecommunications and road-safety laws. Do not use the service while driving in a way that breaks distracted-driving laws.
- Not attempt to access accounts or data that are not yours, probe or break the service's security, overload it, reverse engineer it except as the law permits, or use automated tools to copy data from it outside our API.
- Not resell or provide the service to others without a written agreement with us.
We may suspend or end access that breaches this section, and report unlawful use to the authorities.
9. Your data
- The data your trackers and users put into the service (locations, history, sensor readings, driver records and content you create) is yours. You give us permission to store and process it to provide the service, as our Privacy Policy describes.
- You can export your data with the reports and API while your account is active, and ask us for an export for up to 30 days after it ends.
- We keep and delete data according to our retention periods, unless you ask us to keep it for a different period or a contract says otherwise.
- We may use aggregated information that does not identify you or any person, such as overall usage statistics, to operate and improve the service.
10. Coverage and accuracy
Trackers depend on GPS satellites, cellular networks and power supplies that are outside our control. Positions can be inaccurate or delayed, and a tracker cannot report where there is no coverage. Speed limits, addresses, maps and traffic come from third-party and open data and may be wrong. Rangetel is not an emergency service: an SOS button or alert is not a substitute for calling 911 or your local emergency number, and the service must not be relied on for safety-critical decisions.
11. Availability and support
We work to keep the service available around the clock, and schedule maintenance to limit disruption. Unless a written agreement says otherwise, we do not guarantee any particular uptime. Support is available by phone and email during business hours in Calgary, Alberta.
12. Intellectual property
Rangetel and its licensors own the service, the software in the trackers and apps, and our trademarks. We grant you a limited, non-exclusive, non-transferable right to use the service and apps for as long as your account is active and these terms are followed. If you send us suggestions, we may use them without obligation to you.
13. Disclaimers
Apart from the commitments in these terms, and to the extent the law allows, the service is provided "as is" and we make no other warranties, express or implied, including fitness for a particular purpose. Some jurisdictions do not allow these exclusions, so they may not all apply to you.
14. Limitation of liability
To the extent the law allows: we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data; and our total liability for all claims relating to the service in any 12-month period is limited to the fees you paid us for the service in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
15. Indemnity
If you are a business, you will compensate us for claims by third parties, and the related costs, arising from your use of the service in breach of these terms or the law, in particular tracking a person without the notice, consent or authority required.
16. Ending the agreement
You can end the agreement by cancelling all plans (section 6). We can end it on notice if you seriously breach these terms and do not fix the breach within 30 days of our notice, or immediately for unlawful use. When the agreement ends, access stops, amounts owed remain payable, and your data is handled as described in section 9. Sections 9 and 12 to 20 continue after it ends.
17. Consumers
If you buy as a consumer rather than for a business, you keep every right the consumer protection law where you live gives you, and nothing in these terms takes those rights away. In particular, consumers in the European Union and the United Kingdom may withdraw from an online purchase within 14 days: for trackers, from the day you receive them (return them unused and in their original packaging); for plans, from the day of purchase, but if you ask us to start the service within those 14 days you pay for the part already provided. To withdraw, tell us at support@rangetel.com.
18. Changes to these terms
We may update these terms. We will post the new version here with a new effective date and give customers at least 30 days' notice of changes that materially affect them. If you do not agree, you can cancel before the change takes effect; continuing to use the service after that means you accept the new terms.
19. Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. The courts of Alberta, sitting in Calgary, have jurisdiction over disputes, except that consumers may also bring proceedings where the law of their home country or province allows. Before going to court, please contact us so we can try to resolve the issue directly.
20. General
- These terms, together with any signed agreement and our Privacy Policy, are the whole agreement about the service.
- If a part of these terms is found unenforceable, the rest stays in effect.
- You may not transfer this agreement without our consent; we may transfer it to a successor of our business.
- Neither of us is responsible for delays caused by events beyond reasonable control, such as network outages, natural disasters or acts of government.
- We send notices to the email address on your account; send yours to support@rangetel.com.
